In an MDL, a handful of representative cases are tried while thousands wait. Bellwethers show both sides what juries do with the evidence, and their outcomes largely set the price of any settlement that follows.

noisy by design

The same evidence can produce a defense verdict in one bellwether and an eight-figure award in the next. Treating any single one as the truth about a drug repeats the mistake in both directions. Usually negotiation: the pattern of outcomes prices a settlement program for the remaining cases. Sometimes remand — cases return to home courts for individual trials.
