The same evidence can produce a defense verdict in one bellwether and an eight-figure award in the next. Treating any single one as the truth about a drug repeats the mistake in both directions. Usually negotiation: the pattern of outcomes prices a settlement program for the remaining cases. Sometimes remand — cases return to home courts for individual trials.
does a bellwether verdict prove causation?
One jury found for one plaintiff on one record. Scientific causation is decided by evidence and regulators on their own schedule — sometimes agreeing, sometimes not.
